HailProof Terms of Service

HailProof provides weather-related information, mapping tools, weather exposure reports, lead generation reports, address-based weather searches, and related data products derived from publicly available and licensed data sources.

Services may include:

• Address-based weather searches
• Weather Exposure Reports
• NOAA-based hail and wind event reports
• Contractor Pro mapping tools
• Lead Generation Reports
• PDF exports
• Interactive weather maps
• Property location searches
• Historical weather event analysis

HailProof does not provide insurance adjusting services, engineering services, legal advice, roofing inspections, damage determinations, or claim handling services.

HailProof reports are informational tools only.

Weather data displayed by HailProof may be derived from public and third-party sources, including but not limited to:

• National Oceanic and Atmospheric Administration (NOAA)
• National Weather Service (NWS)
• Storm Prediction Center (SPC)
• Licensed weather vendors
• Geospatial mapping providers

Weather reports may contain inaccuracies, omissions, delays, reporting errors, or geographic limitations.

HailProof does not guarantee:

• That hail occurred at any specific property.
• That wind occurred at any specific property.
• That property damage occurred.
• That insurance coverage exists.
• That a claim will be approved.
• That a property qualifies for repair or replacement.

Weather proximity alone does not establish causation, damage, or insurance coverage.

HailProof does not determine whether a structure was damaged.

Any weather event identified within a selected radius:

• Is not proof of damage.
• Is not proof of causation.
• Is not proof of insurance coverage.
• Is not proof of a covered loss.

Property condition must be independently evaluated by qualified professionals.

Users are solely responsible for:

• Verifying all report information.
• Conducting independent inspections.
• Confirming property conditions.
• Confirming insurance policy language.
• Complying with local, state, and federal laws.

Users agree not to rely solely on HailProof reports when making business, insurance, legal, construction, or financial decisions.

Lead Generation Reports are intended solely to identify properties located within user-selected weather exposure parameters.

Lead Generation Reports:

• Do not represent damaged properties.
• Do not represent verified losses.
• Do not represent insurance claims.
• Do not guarantee sales opportunities.
• Do not guarantee storm-related damage.

Users are solely responsible for complying with all applicable solicitation, marketing, privacy, and consumer protection laws.

HailProof assumes no responsibility for how users contact property owners.

Certain features require a paid subscription.

Contractor Pro provides ongoing access to platform tools and data features. Plans include monthly included usage intended for good-faith professional use. Usage beyond included amounts may incur additional per-unit charges when you opt in to pay-as-you-go billing.

Subscription fees:

• Are billed in advance.
• Are non-refundable except as required by law.
• May be modified upon reasonable notice.

HailProof may throttle usage, require a higher plan, or suspend access for automated bulk extraction, reselling, or usage that exceeds reasonable professional patterns or threatens platform stability.

Failure to pay subscription fees or approved additional-usage charges may result in suspension or termination of access.

Purchased reports are generated based on:

• User-selected locations
• User-selected date ranges
• User-selected search parameters

Because reports are delivered immediately upon generation, report purchases are generally non-refundable.

HailProof reserves the right to issue refunds at its sole discretion.

You agree not to:

• Reverse engineer the platform.
• Copy or reproduce proprietary reports.
• Scrape data from the Services.
• Resell reports without authorization.
• Use automated bots to overload the platform.
• Circumvent subscription or included-usage limitations.
• Interfere with platform functionality.

HailProof may suspend or terminate accounts violating these restrictions.

All platform content, including:

• Software
• Maps
• Report formats
• Graphics
• Branding
• Scoring methodologies
• Filtering systems
• Impact zone calculations
• Lead generation algorithms

are the exclusive property of HailProof or its licensors.

No ownership rights are transferred to users.

Any grading, ranking, prioritization, impact scores, weather exposure scores, filtering methods, calculations, algorithms, or proprietary analytical outputs generated by HailProof constitute confidential trade secrets.

Users may use resulting reports but may not:

• Extract methodologies
• Replicate calculations
• Reverse engineer scoring systems
• Build competing services from HailProof outputs

HailProof may utilize third-party providers, including:

• Mapping services
• Geocoding services
• Payment processors
• Hosting providers
• Weather data providers

HailProof is not responsible for outages, errors, or failures caused by third-party providers.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAILPROOF DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• RELIABILITY
• CONTINUOUS AVAILABILITY

HAILPROOF DOES NOT WARRANT THAT REPORTS ARE ERROR-FREE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAILPROOF SHALL NOT BE LIABLE FOR:

• LOST PROFITS
• LOST BUSINESS OPPORTUNITIES
• LOST REVENUE
• LOST DATA
• CLAIM DENIALS
• INSURANCE COVERAGE DISPUTES
• PROPERTY DAMAGE CLAIMS
• INDIRECT DAMAGES
• INCIDENTAL DAMAGES
• CONSEQUENTIAL DAMAGES

IN NO EVENT SHALL HAILPROOF'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER TO HAILPROOF DURING THE PRECEDING TWELVE (12) MONTHS.

You agree to defend, indemnify, and hold harmless HailProof and its officers, owners, affiliates, employees, and contractors from any claims, damages, liabilities, or expenses arising from:

• Your use of the Services.
• Your marketing activities.
• Your solicitation activities.
• Your violation of applicable laws.
• Your reliance on report information.

HailProof may suspend or terminate access at any time for:

• Violation of these Terms
• Fraudulent activity
• Abuse of the platform
• Security concerns
• Non-payment

HailProof may update these Terms from time to time.

Continued use of the Services after updates constitutes acceptance of the revised Terms.

These Terms shall be governed by the laws of the State of Tennessee without regard to conflict of law principles.

Any dispute arising from these Terms shall be brought exclusively in the state or federal courts located in Tennessee.
